These terms are an agreement between you and BesidesGuide LLC, a California limited liability company ("we", "us"), covering OutfitScenes — the website at outfitscenes.com and the OutfitScenes app for Shopify (together, the "Service"). By creating an account or using the Service you agree to them. If you use the Service for a business, you agree to them on behalf of that business, and "you" means the business.
1. What OutfitScenes does
You give us photos of products you sell — clothing, shoes and bags. We make new photographs and short videos of those products being worn, by generated people in real-looking places, for your store, your product pages and your ads. The people in our photographs are not real; see Models & likeness and AI disclosure.
2. Who can use it
The Service is for businesses and people selling products. You must be at least 18 years old and able to make a binding agreement.
3. Your account
You sign in with a code sent to your email address, with Google, or — in the Shopify app — through your Shopify store. There is no password, so whoever controls your email address or your store controls your account. Keep them secure, and tell us at support@outfitscenes.com if you think someone else has access.
One account per store. The welcome credit is given once per account; opening extra accounts to collect it again is not allowed, and we may close accounts that do.
4. Prices, balance and payment
You pay for what you use, from a prepaid balance. Each action shows its price before it starts: a photograph, a video, a model made from your photos, checking a product's photos. Current prices are on our pricing section. We may change prices; a change never applies to work already started.
- We only charge for what we deliver. When you start a shoot we set aside the cost; when it finishes we charge for the photographs that came out and release the rest. If something fails on our side, you are not charged for it.
- Fixes. If a photograph is not right, tell us what is off and we make it again. The first two fixes of each photograph are free; after that a fix costs the same as a new photograph, and we say so before you send it.
- Adding funds. On the website you pay by card through Stripe. In the Shopify app you are billed by Shopify, on your Shopify invoice. Larger top-ups may come with bonus credit, shown before you pay.
- Your balance does not expire. It is not cash, it cannot be transferred to another account, and it earns no interest.
- Refunds. Money you added and have not used can be refunded on request within 30 days of the payment, to the card or Shopify account it came from — write to support@outfitscenes.com. Bonus credit and the welcome credit are not refundable. Credit you have used to make photographs or videos is not refundable, because the work has been done; if a result was wrong, use a fix.
- Taxes. Prices do not include sales tax or VAT where it applies.
5. Your photos and products
You keep everything you own in what you upload. By uploading a photo you confirm that you have the right to use it this way — that you took it, own it, or have permission — and that the product in it is genuine and yours to sell.
You give us permission to store and process your photos only to provide the Service to you: to understand the product, to make your photographs and videos, and to keep a backup. We do not show your products or your photographs to other customers, and we do not use them to train image or language models. Our service providers process them on our instructions (see the Privacy Policy).
6. What we make for you
The photographs and videos we make for you are yours to use, for any lawful purpose — your store, marketplaces, social media and paid ads, in any size, for as long as you like. To the extent we hold any rights in them, we assign those rights to you once they are delivered. Generated images may not be protected by copyright in every country; we cannot give you more rights than the law allows.
We will not use the photographs we make for you in our own marketing without your permission.
Settings. We do not repeat a setting for your store, but settings are not exclusive: another store may get a photograph in a similar place or pose, with its own products.
7. Check before you publish
We check every photograph before it reaches you, and you can ask for a fix when something is off. Still, the photographs are generated, and a detail can come out differently from your product — a seam, a print, a length. Look at each photograph before you publish it. You are responsible for what you publish and for following the rules of the places you publish it, including any rule that AI-generated images be labelled as such (see AI disclosure).
8. Rules
Follow our Content rules. In short: only products you have the right to sell, only photos you have the right to use, nothing sexual, nothing involving minors, no real person's likeness without their consent, and nothing unlawful or deceptive. Do not scrape, overload, resell or reverse engineer the Service. We may refuse, remove or not deliver content that breaks the rules, and we may suspend accounts that do.
9. No warranty
The Service is provided as is and as available. We do not warrant that it will be uninterrupted or error-free, or that any photograph will meet your expectations or a platform's requirements. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
10. Limitation of liability
To the fullest extent permitted by law, BesidesGuide LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and one hundred United States dollars ($100).
Nothing here limits liability for fraud, gross negligence, or anything else that cannot lawfully be limited.
11. Your responsibility to us
If a claim is brought against us because of photos or products you gave us, or how you used what we made for you, in breach of these terms, you will cover our reasonable costs of dealing with it.
12. Changes and ending
The Service will change. We may change these terms; if a change matters, we will post it here and update the date before it takes effect, and email you if it affects money you have already paid. Continuing to use the Service afterwards means you accept it.
You can stop at any time and ask us to close your account. If you use the Shopify app, uninstalling it closes that store's account, and we delete its data as described in the Privacy Policy. We may suspend or close an account that breaks these terms; if we close it for a reason other than a breach, we refund the unused balance you paid for. Sections 4 (refunds), 5, 6, 9, 10, 11 and 13 survive.
13. Law and disputes
These terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in California, and you and we consent to their jurisdiction. If any part of these terms is unenforceable, the rest stays in force.
